These terms and conditions ("Terms") govern your use of inthehighlands.com (the "Website"), operated by In The Highlands ("we", "us", "our"), and set out the rules for connected products developed by our associated studio, Mad Raccoon Studios — currently the 282Club app and the upcoming game Hill Climb Hiker. Sections 11–13 below apply specifically to those products, in addition to the general terms that apply throughout.
By using the Website, or downloading or using 282Club or Hill Climb Hiker, you agree to these Terms. If you don't agree with any part of them, please don't use the Website or those apps.
You must be at least 16 years old to create an account on the Website, or to use 282Club or Hill Climb Hiker without a parent or guardian's supervision. By using our services, you confirm that you meet this requirement, or that you're doing so with appropriate parental consent.
You agree to use the Website only for lawful purposes. In particular, you agree not to:
We may suspend or terminate your access to the Website, without notice, if we reasonably believe you've breached these Terms.
If you register an account to leave reviews or save listings, you're responsible for keeping your login details secure and for all activity under your account. Reviews you post should reflect your genuine experience — we reserve the right to remove reviews that appear fake, are unrelated to the listing, contain abusive content, or otherwise breach these Terms, without needing to give advance notice.

If you list, claim, or advertise a business on the Website (including paid listings, sponsor carousel banners, or the sitewide ad banner), the following applies:
Digital products sold through the Website (such as PDF guides, including The Complete NC500 Guide, and any accompanying files like GPX route files) are supplied for your personal, non-commercial use only. You may not resell, redistribute, or publicly share the file itself.
Because digital products are delivered instantly on purchase, and in line with standard UK distance-selling exceptions for digital content, we're unable to offer refunds once a digital product has been downloaded, except where the product is faulty, doesn't match its description, or you're otherwise entitled to a refund by law. If you have a problem with a digital purchase, contact us at the email below and we'll do our best to help.
Download links are time-limited and capped at a set number of uses (shown at the point of purchase) to protect against unauthorised sharing. If you lose access before downloading your file, contact us with your order details.
Physical products bought through our shop are sold subject to your usual rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. In summary:

The Website links to third-party businesses, booking platforms (such as FareHarbor), and affiliate partners. We aren't responsible for the content, accuracy, availability, or booking terms of any third-party site, and any transaction you make with a third party is between you and them, subject to their own terms and privacy policy.
Some links on the Website are affiliate links, meaning we may earn a commission if you make a purchase through them, at no extra cost to you.
We work to keep listings, trail and Munro information, safety guidance, fuel/EV/amenity locations, and route data accurate and up to date, but the Highlands change — businesses close, road conditions shift, and facilities move. We can't guarantee that all information on the Website is complete, current, or error-free, and you should always check live conditions (road closures, weather, opening hours) directly before relying on this information for travel, particularly for hill walking and remote routes. See our Safety & Access page for further guidance.
Unless otherwise stated, the Website's design, text, graphics, and underlying code are owned by us or our licensors and protected by copyright. You may view and print pages for your own personal use, but may not reproduce, republish, or distribute content from the Website without our permission, except where content is explicitly provided for download (such as a purchased digital guide, used under section 6 above).
Mad Raccoon Studios is our associated games and apps studio, connected to In The Highlands as part of the same wider group of projects. Mad Raccoon Studios currently develops:
These products are separate downloadable apps, not part of the Website itself, but are covered by these Terms because of their shared branding and connection to inthehighlands.com. Where an app has its own additional terms (for example, terms required by the Google Play Store or Apple App Store), those app-store terms apply alongside, not instead of, this section.
282Club is a Munro-bagging tracker for Android, letting you log climbs, track progress toward all 282 Munros, and use interactive maps. In using 282Club, you agree that:
Hill Climb Hiker is a hiking and climbing game currently in development by Mad Raccoon Studios. As the game is a work in progress, features, release platforms, pricing, and release dates described anywhere on the Website or in promotional materials are subject to change without notice, and nothing on the Website constitutes a guarantee that the game will be released in any particular form or timeframe.
Once released, use of Hill Climb Hiker will be subject to these Terms together with any additional terms provided at the point of download or purchase (including, where applicable, the terms of the platform you download it from).
To the fullest extent permitted by law, we exclude all liability for any indirect or consequential loss arising from your use of the Website, 282Club, or Hill Climb Hiker. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that can't be excluded under UK law.
This is particularly important given the nature of some content on the Website: information about hillwalking, driving conditions, and outdoor activities is provided for guidance only, and you undertake any outdoor activity, including any suggested via 282Club or referenced via Hill Climb Hiker, at your own risk.
These Terms are governed by the law of Scotland, and any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
We may update these Terms from time to time, for example as the Website or Mad Raccoon Studios' products evolve. Any changes will be posted on this page with an updated "last updated" date. Continuing to use the Website or our apps after changes are posted means you accept the updated Terms.
